PLEASE TAKE NOTE that on January 12, 2009, the judge
of the Superior Court of California, San Benito County,
issued an Order and Judgement Granting Petition and
Peremptory Writ of Mandamus in the matter of the City of
San Juan Bautista Growth Management Plan (GMO). The GMO
is determined to be invalid because of three reasons,
(1) it contradicts the General Plan, (2) it is in
violation of state housing law, and (3) the GMO requires
that all proposed residential developments greater than
four units be approved by a vote of the electorate and
approval of such projects is not a legislative act and
so cannot properly be the subject of a referendum vote.
Thus, the GMO improperly delegates the City Council's
approval powers to the electorate. Please use link to
