March 4, 2008

 

  1. Call to Order at 7:07 p.m. by Chairperson Reuben Garza

      A.  Roll Call

Members Present: Reuben Garza, Jeff Bagley, Dan McMath, Erika Spencer and Wanda Guibert.

Staff Present: Jan McClintock, City Manager; Matthew Sundt, City Planner; and Trish Paetz, City Clerk.

Ponzini: Re: Received very alarming code enforcement letter.  Jan: Complaints on nine buildings in downtown SJB.

B.  Approval of Minutes of February 12, 2008 Planning Commission Meeting

A motion was made by Commissioner Spencer and seconded by Commissioner McMath to approve all consent items.  The motion passed unanimously.

 

  1. Public Hearing Items

A.  Davidson Sphere of Influence Amendment

City Planner Sundt report that this item will be continued to the April Planning Commission meeting, that is, the Commission will not make a recommendation to Council tonight but can hear the public. 

 

City Planner Sundt presented his staff report stating the SOI (Sphere of Influence) boundary and Planning Area Boundary do not follow any property boundary or geographic feature or roads.  Consequently, the SOI boundary line bifurcates a number of properties including the Charles Davidson properties, which are the subject of this SOI amendment; the existing SOI bifurcates APN 023-160-008 and APN 023-160-004.  With the parcels bifurcated there results an unnecessary constraint to the potential development of all the Davidson parcels.  This proposed SOI amendment will result in a new SOI boundary that respects property boundaries resulting in a practical SOI boundary.  The proposed SOI amendment also includes amending the General Plan so as to change the Planning Area Boundary.  Approval of the proposed SOI amendment will not cause changes to existing public services operations, nor would there be any fiscal impact associated with this proposed amendment.  If the property is annexed to the City and depending on what project may be proposed there may be the need to amend the General Plan so as to allow expansion to the Urban Growth Boundary.

 

The City Planner asked the public for any questions regarding the map.

 

Jolene Cosio asked where the City well was located and City Manger McClintock pointed to it on one acre owned by the City. 

 

Commissioner Guibert asked who paid for the map, and City Manager McClintock explained it was a map developed during the Specific Plan process and was paid for by multiple agencies.

 

Staff explained that the City Planner received a letter today from LAFCO Director Judi Johnson, suggesting that further noticing is required; therefore, the process is being delayed for another month.

 

Commissioner Guibert asks why an EIR (environmental impact report) was not being conducted, and City Manager McClintock responded that it was too soon to get an EIR.  Commissioner Guibert then asked about the availability of water, and City manager McClintock responded, there was plenty of water but not of good quality.

 

Jolene Cosio stated that the City can not afford to spend money on a project that the City does not have the infrastructure to support.

 

Emily Renzel offered a “simple solution” involving LAFCO and 115 acres and commented there could be some Indian remains in the area of the cement plant.  City Manager McClintock responded that the Mutsun tribe is a City stakeholder.

 

In response to Jolene Cosio’s comment about the City’s infrastructure, City Manager McClintock stated the bid process should begin the first of May for construction of storm drains.

 

Commissioner Guibert asked if it would be possible to view the property, and City Manager McClintock said the mayor would be the best candidate to conduct the field trip.

 

No action was taken on this item and it was continued to next month.

A.  Planning Commissioners

When Commissioner McMath asked when the Mission Café would re-open, staff responded, soon.

 

B.  City Manager

City Manager McClintock announced there would be a ribbon cutting at the newly renovated Community Center the last Saturday in March, and thanked Pat Garratt for his work on the project.

 

C.  City Planner

            City Planner Sundt presented a progress report, updating the Commission on projects he

            is working on.

A motion to adjourn the meeting at 8:27 p.m. passed unanimously.
